General Terms and Conditions AMAG Services AG

These General Terms and Conditions (“GTC”) form an integral part of this rental agreement between the Lessee and AMAG Services AG in Kloten as Lessor. By signing this rental agreement, the Lessee confirms to have read and unconditionally accepts the GTC.
1. Vehicle takeover
The Lessee takes over the vehicle with a full tank/min. 80% load capacity and in safe, clean condition. Any equipment, such as snow chains, child seats, charging cable, etc., are noted separately in the rental agreement and are in perfect condition. Complaints on the part of the Lessee regarding the vehicle and/or equipment must be reported to the Lessor immediately upon receipt.
2. Vehicle return
The vehicle and all the equipment listed in the rental agreement must be returned in proper condition to the return station specified in the rental agreement at the time specified in the rental agreement. The Lessee shall compensate for any financial loss incurred in the event of delay and shall also be liable for any fortuitous event. In case of return to a rental station other than the one specified in the rental agreement, the Lessee shall pay the cost of returning the vehicle to the rental station. If the Lessee fails to return the vehicle with a full tank of petrol/min. 80% of the load capacity, said Lessee shall pay the cost of the fuel/electricity as well as the refuelling/charging service. In the event of any other improper return of the vehicle and/or equipment, the Lessee shall be liable in accordance with section 12 of these GTC. In any case, the return can only be made within the standard opening hours of the respective return station and to an employee or a person specially authorised by the Lessor. In particular, the mere parking of the vehicle at the return station with the deposit of the keys to the Lessor does not result in a proper return.
3. Extension of the rental period
An extension of the rental agreement is only possible with the written consent of the Lessor prior to termination of the current rental agreement. An additional deposit must be paid to cover the costs of the extended rental period. The Lessor may refuse an extension without giving reasons. At the Lessor’s request, the Lessee must show the vehicle at a rental station. Insofar as an extension of the rental agreement is agreed, all conditions of the original rental agreement continue to apply unchanged, unless otherwise agreed in writing.
4. Minimum age / Driving License / Identity Card, Passport
The minimum age for renting or driving a vehicle from the Lessor depends on the category of the vehicle rented and is: for categories U… (Premium Elite)/L... (Luxury)/W… (Luxury Elite)/O… (Oversize)/X... (Special) except vehicles with 6 and more seats 25 years, for vehicles with 8 - 16 seats 21 years, for all other vehicles 19 years. The Lessee must also have held a valid driving license for at least 1 year at the beginning of the rental. Digital driving licenses (e-licenses) are not accepted. A driving license must not have a geographic limitation or bear any designations or inscriptions indicating a possible geographic limitation. For drivers under 25 years of age, regardless of the category of vehicle rented, an additional fee for young drivers will be charged per rental day, which will be indicated in the rental agreement. The Lessee and any additional drivers agree that their driving license and ID/passport will be electronically read, verified and stored for a certain period of time.
5. Authorised drivers
The vehicle may only be driven by the Lessee himself/herself and by the drivers whose name and addresse are listed in the rental agreement. For additional drivers, the provisions of section 4 apply analogously. The Lessee remains responsible to the Lessor for the fulfilment of all obligations arising from the rental agreement and the associated additional conditions, even if he/she does not drive the vehicle himself/herself. For additional drivers, an additional fee will be charged per rental day, which will be stated in the rental agreement.
6. Rental price
The rental price is calculated per rental day, where a rental day is equivalent to 24 hours, unless otherwise stated in the rental agreement. The rental price is stated in the rental agreement and includes the use of the vehicle specified in the rental agreement for the agreed duration and, if agreed, additional charges for collision/accident/theft protection, insurance, equipment, young drivers, additional drivers, return service, fuel/electricity, refuelling/charging service, etc., as well as limitations of the Lessee's liability. With the exception of the Swiss motorway vignette, the rental price does not include any taxes, vignettes, tolls or other charges related to the use of the vehicle, especially those levied abroad. In case of late return more than 30 minutes, an additional rental day will be charged for each commenced 24 hours. In case of early return, the rental price per rental day may change at the expense of the Lessee.
7. Payment method
For each rental, a means of payment accepted by the Lessor must be presented and a deposit must be paid. Cash transactions are not accepted. If the deposit is paid by means of a payment card accepted by the Lessor, the Lessee authorises the Lessor to reserve a credit with the card issuer that corresponds to all the foreseeable obligations of the Lessee under the rental agreement, plus a security deposit. The final price will be deducted from the security deposit upon return of the vehicle and termination of the rental agreement. If no or insufficient deposit can be made, the Lessor has the right not to provide the Lessee with a vehicle despite reservation and prepayment made. The Lessor is authorised and entitled to charge the Lessee's liabilities arising from or in connection with the rental (e.g., costs of towing, fuel/electricity, repair, etc., as well as fines or penalties and administration fees) with the means of payment provided to cover the rental costs. The final invoice shall be deemed to have been approved unless the Lessee submits a written complaint to AMAG Services AG, Steinackerstrasse 20, CH-8302 Kloten, within 30 days.
8. Use / Maintenance / Repairs
The Lessee must use the rental object with care and regularly check the fluid levels and tyre pressure and must comply with control and warning lights. The Lessee must observe all traffic and legal regulations and must carefully inform himself/herself about the traffic regulations of the countries he/she is travelling with the vehicle. The Lessee is not entitled to make any changes to the vehicle or its howequipment, fittings or configuration (e.g. installation, removing seats or benches). All changes made during the rental period will be reversed or rectified professionally at the expense of the Lessee. The Lessee must immediately report any defects that they are not required to remedy themselves to the Lessor and follow their instructions regarding the rectification of defects. Expenses incurred in connection with defects (such as fluids, spare parts, repair costs) require the prior approval of the Lessor. Expenses incurred within the scope of a cost approval will be reimbursed to the Lessee upon return of the rental object upon presentation of the relevant receipts. Repairs on the Lessee’s own initiative are prohibited.
9. Conduct in the event of accidents and special events
In the event of an accident, theft (theft/misappropriation, etc.), loss, fire, wildlife or other damage, the Lessee must immediately notify the police and have a police report drawn up. This also applies to self-inflicted accidents without the involvement of third parties. Claims from other parties must not be accepted. In the event of all mentioned events, even in the case of minor damage, the Lessee must immediately notify the Lessor and do everything possible to clarify the facts and minimise the damage, in particular by completing the damage report form in full and legibly, signing it and handing it over to the Lessor. In the event of an accident, the damage report must include in particular the names and addresses of the individuals involved and any witnesses, as well as the registration plates of the vehicles involved. In the event of theft, the vehicle keys, a report on the course of the theft and the police report must be submitted to the Lessor within 24 hours. In the event of a breach of the obligations under this section, the Lessee shall be fully liable for any damage related to the aforementioned circumstances, and any agreed limitation or waiver of liability shall no longer apply (see section 12f).
10. Prohibited uses / Entry restrictions / Exit restrictions
I. The Lessee is prohibited from using the vehicle:
a. to participate in motor sport events, vehicle tests and driving lessons.
b. to transport passengers for remuneration.
c. to tow, haul or otherwise move another vehicle, unless the rental vehicle is vehicle designed for this purpose.
d. in an overloaded condition, i.e., with a number of passengers or a payload exceeding the values specified in the vehicle registration document.
e. for the transport of flammable, explosive, toxic or dangerous substances
f. for the commission of customs offences and other criminal acts, even if such acts are punishable only under the law of the place where they are committed.
g. for subletting.
II. The use of the vehicle is permitted in the following countries:
a. Austria, Belgium, Croatia, Czech Republic, Denmark, Finland, France, Germany, Great Britain, Hungary, Ireland, Italy, Luxembourg, Norway, Portugal, Slovakia, Slovenia, Spain, Sweden, Switzerland, The Netherlands. This also applies to the use of the vehicle on islands within these countries (except: Azores, Canary Islands, Madeira and overseas territories). The use of the vehicle in Croatia, Slovakia, Slovenia, the Czech Republic and Hungary is only permitted with the prior consent of the Lessor and the conclusion of a cross border surcharge and must be stated on the rental contract. The cross border surcharge does not cover any taxes, vignettes, tolls or other charges related to the use of the vehicle; such charges are to be paid by the Lessee himself. The use of the vehicle in any other country constitutes a material breach of contract and results in the invalidity of all liability limitations.
b. All vehicles of categories U… (Premium Elite), L… (Luxury), W… (Luxury Elite), O… (Oversized), X… (Special) are expressly prohibited from crossing the border into Croatia, Slovakia, Slovenia, the Czech Republic and Hungary. Vehicles with 6 or more seats (buses) are excluded.
III. Customs regulations for the use of the vehicle with Swiss registration plates:
a. The Lessee is obliged to inform all registered additional drivers of the conditions in section 10 III and to demand compliance with them.
b. Lessees resident in the EU and registered additional drivers undertake to return the vehicle with Swiss registration plates to the Lessor within 8 days.
IV. Customs regulations for the use of the vehicle with foreign (non-Swiss) registration plates:
a. The Lessee is obliged to inform all registered additional drivers of the conditions in section 10IV and to demand compliance with them.
b. Lessees resident in Switzerland and registered additional drivers undertake to take the vehicle with foreign (non-Swiss) registration plates directly abroad within 48 hours and thus not to return to Switzerland.
c. Lessees resident abroad and registered additional drivers undertake to use the vehicle with foreign (non-Swiss) registration plates for the duration of the rental period across borders.
d. Failure to comply with the conditions in sections 10IVb and 10IVc is punishable by law.
11. Condition of the vehicle and inspection upon return
At the time of pickup and return, the condition of the vehicle is inspected and documented. At certain stations, this inspection is additionally carried out by automated systems that record damage and generate reports. For technical reasons, the provision of these reports may be delayed; however, this does not affect the Lessee’s liability. The Lessee is liable for any damage detected at the time of return and not already documented at the time of pickup, regardless of whether a return protocol is signed. By signing the rental agreement, the Lessee authorises the Lessor to collect the amounts payable in the event of loss or damage. If possible, the Lessor will be charged to the means of payment provided by the Lessee, otherwise it will be claimed separately.
12. Liability and limitation of liability
a. The Lessee is liable for all damage to the vehicle (in particular tyre and glass damage) as well as any loss or destruction of the vehicle, regardless of whether the Lessee is at fault or responsible. In particular, the Lessee is also liable for the conduct of additional drivers and assistants, whose conduct shall be taken into account without restriction as his/her own.
b. For light/minor damages, the Lessee must pay the costs listed in the damage list. Light/minor damages are those listed in the damage list available at the rental desk.
c. Furthermore, the Lessee is liable in particular for all defects or damage to the rental object for which he/she is responsible. This includes, but is not limited to, damage caused by: refuelling with the wrong fuel, failure to observe control or warning lights or maximum heights at garage entrances, underpasses, etc.; improper use of snow chains, ski racks, careless loading of ski racks, careless handling of the vehicle interior (in particular cigarette burns, cracks and stains on upholstery and carpets), off-road driving and generally careless handling (in particular damage to the underbody such as steering, transmission, suspension and springs, as well as damage to axle parts, sills, oil pan, pipes, exhaust systems, shielding plates and covers), improper handling of vehicles (mechanical damage to the clutch, transmission, suspension, etc., which are not covered by warranty at authorised garages), improper handling of convertible tops (in particular failure to close the top in rain, wind, etc.).
d. The scope of liability includes repair costs or the value of the vehicle in the event of a total loss, as well as any other financial loss such as towing costs, expert appraisal costs, depreciation of the rental object, lost rental income, legal fees and administrative fees.
e. If, in connection with the use of the vehicle, fines, penalties, unpaid fees (e.g., motorway tolls), administrative charges, or other third-party claims arise for which the Lessor is held liable, the Lessee must reimburse the Lessor for the corresponding amount plus administrative fees. This does not include fines, penalties, fees, compensation for expenses and other claims incurred through the fault of the Lessor. In the event of violations of traffic laws or other legal infringements, as well as non-payment of fees, administrative charges, or other third-party claims in Switzerland or abroad, the Lessee authorizes the Lessor to disclose contract data to all official authorities (police, prosecutors, road traffic offices, etc.), to private companies commissioned by authorities (e.g., motorway concessionaires or collection agencies), and to other claimants in Switzerland and abroad. Where necessary, the Lessee's personal data will be processed by the Lessor or third parties in compliance with the applicable data protection laws. Further information on data protection can be found in the Lessor's privacy policy.
f. If coverage is agreed in accordance with the principles of collision/accident/theft protection, the Lessee's liability is reduced to the deductible per incident agreed in the rental agreement, whereby a minimum age applies for certain packages (e.g. for the PREMIUM package, the minimum age is 26 for all drivers registered on the rental agreement). The liability reduction/exemption does not apply in the event of gross negligence or intentional damage, unlawful or contractually prohibited or careless behavior by the Lessee or their assistants, in particular in the event of violation of reporting and cooperation obligations in accordance with section 9, use of the vehicle by an unauthorised driver or for a prohibited purpose, hit-and-run by the Lessee or their assistants, fatigue, driving under the influence of alcohol or drugs, or for damage caused by the cargo. Furthermore, the liability reduction/exemption does not apply to the damages listed in section 12c, unless there is no cover for the damage of the Lessor in the specific case.
g. Any liability waiver granted to the Lessee by the Lessor is only valid if provided in writing.
13. Vehicle localization
Vehicles may be equipped with tracking systems for localisation purposes. The Lessee expressly gives the Lessor consent to locating/tracking if a) the vehicle is not returned at the agreed time b) the vehicle is used outside the contractually agreed area c) it is stolen d) in the event of an accident. The collection, storage and use of data is solely for the purpose of protecting the vehicle fleet. The Lessor may be obliged to disclose this data by order of authorities.
14. Liability of the Lessor
The Lessor shall be liable for damages incurred by the Lessee as a result of a defect in the vehicle, in accordance with the requirements of Articles 259a and 259e of the Swiss Code of Obligations, unless liability is otherwise regulated by an individual agreement. Otherwise, any contractual and non-contractual liability of the Lessor towards the Lessee and any other persons entitled under the rental agreement is excluded, unless the Lessor has caused the damage intentionally or through gross negligence. The Lessor is not liable for damage caused by its auxiliary persons.
15. Right of retention
Any right of retention of the Lessee on the vehicle for asserted claims against the Lessor is excluded.
16. Amendments to the contract
Additions and amendments to the rental agreement must be made in writing to be valid.
17. Applicable law / Place of jurisdiction
The rental agreement is subject to Swiss law. The place of jurisdiction is Zurich.
